Terms of Service

Welcome to CMWDS ("CMWDS", "we", "us"), an AI-powered website and app builder operated by NerdyTechs. By creating an account or using the service, you agree to these Terms of Service. If you do not agree, do not use CMWDS.

1. What CMWDS does

CMWDS lets you describe a website or application in plain language, and our AI generates, previews, and hosts it for you. You can iterate by chatting, generate images and video, publish your site to a CMWDS subdomain or your own custom domain, and download your project files.

2. Your account

You must provide accurate information when you sign up and keep your login secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use CMWDS.

3. Credits and billing

CMWDS uses a credit system. New accounts receive a limited number of free credits. Building a site or app, and generating images or video, each consume credits based on the work performed.
You may purchase additional credits through our payment processor, Square. All prices are in U.S. dollars.
Credits and purchases are generally non-refundable except where required by law, because AI generation incurs real compute costs at the time of use. Credits have no cash value and are not transferable.
We may change credit pricing and free allowances at any time; changes apply to future purchases and grants.

4. Your content and ownership

You own the websites, apps, text, and other content you create with CMWDS, subject to any third-party assets (such as fonts, stock photos, or libraries) that carry their own licenses. You are responsible for ensuring your content and your use of it are lawful. You grant CMWDS a limited license to host, process, display, and back up your content solely to operate the service.

5. AI-generated output

CMWDS uses artificial intelligence, including third-party models, to generate code, designs, images, and video. AI output can contain errors, may be similar to output generated for other users, and is provided "as is." You are responsible for reviewing, testing, and taking ownership of anything you publish. Do not rely on generated code, legal text, or factual claims without your own review.

6. Acceptable use

You agree not to use CMWDS to create, host, or distribute anything that:

is illegal, infringing, defamatory, or violates others' rights;
contains malware, phishing, spam, or is used to attack or deceive others;
hosts adult exploitation content, promotes violence or hate, or facilitates fraud;
attempts to abuse, overload, reverse-engineer, or circumvent the service, its limits, or its billing.

We may suspend or terminate accounts, and remove or take down sites, that violate these terms.

7. Hosting, previews, and publishing

Sites you build are hosted by CMWDS on preview URLs and, if you publish, on your own domain. We provide hosting on a reasonable-effort basis and do not guarantee uninterrupted availability. You are responsible for your own domain registration and DNS unless you purchase a domain through us.

8. Custom domains and domain purchases

If you connect or purchase a domain, you are responsible for the accuracy of registration details and for complying with the registrar's and ICANN's requirements. Domains purchased through CMWDS are registered on your behalf through our registrar partner and are subject to their terms.

9. Third-party services

CMWDS relies on third parties, including AI model providers, Square for payments, Cloudflare for delivery, and a domain registrar. Your use of the service is also subject to their terms where applicable.

10. Disclaimers and limitation of liability

CMWDS is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, NerdyTechs is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the three months before the claim.

11. Termination

You may stop using CMWDS and delete your account at any time. We may suspend or terminate access for violations of these terms or to protect the service. On termination, your hosted sites may be taken offline; download your project files first if you want to keep them.

12. Changes

We may update these terms. Material changes will be posted here with a new "last updated" date. Continued use after changes means you accept them.
